Coloplast Corporation Sued Over Transvaginal Mesh Injuries

A new lawsuit filed against the Coloplast Corporation and others alleges that a woman experienced serious transvaginal mesh side effects after using several of the company’s TVM products. Her transvaginal mesh lawsuit joins thousands of others filed in a multi-district litigation (MDL) that is pending in the U.S. District Court for the Southern District of West Virginia.

Defective & Dangerous Products

That’s how a Texas woman’s lawsuit describes the three transvaginal mesh products that were used to treat her pelvic organ prolapse (POP) and stress urinary incontinence (SUI) conditions. According to her lawsuit, she was treated with:

  • Coloplast’s Novasilk-Synthetic Flat Mesh System in May 2011
  • CR Bard’s Alyte Y-Mesh System in October 2012
  • Johnson & Johnson / Ethicon’s Gynecare TVT Exact in October 2012

Her lawsuit, like so many others, alleges that these mesh devices are defective, dangerous and caused her to suffer serious, and perhaps permanent, transvaginal mesh injuries. Mesh erosion is one of those injuries.

According to the Minneapolis St. Paul Business Journal, the U.S. Food & Drug Administration found that approximately 10% of women with transvaginal mesh inserts for pelvic repair experienced erosion of the mesh within 12 months of surgery. In addition to mesh erosion, the FDA claims that the most reported transvaginal side effects are:

  • Pain
  • Infection
  • Bleeding
  • Pain during sexual intercourse (dyspareunia)
  • Organ perforation
  • Urinary problems
  • Recurrent prolapse
  • Neuro-muscular problems
  • Vaginal scarring/shrinkage
  • Emotional problems

Lawsuits against the companies allege that they knew about the dangers of TVM but failed to warn consumers in order to protect their own financial interests. Many lawsuits seek compensation for economic losses such as medical costs and lost income and non-economic losses such as pain and suffering, as well as punitive damages to punish the companies for acting irresponsibly and without regard to patient safety.
